No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

Owing to this double need, Kant seems to be against himself and consequently the most critical and dialectical interpretation of Kant's thought is opposed to the (...) formalistic absolutism used by the Kantian jurists, who reject the most vital and profound critical philosophy for a metaphysical framework which confuses everything as though all were homogeneous. In fact, what appears more valid in Kant's philosophy is the continuous tension between formalism and dialectics, a tension which, even though it is never definitively overcome in a dialectical sense by Kant himself, nevertheless reveals the need for a legal dialectic rather than a formalism. It shows "the destiny of legal right to cease being a coercive apparatus, and of being transformed into rules for human society taken from civil society" (p. 390). Of course, this dialectical perspective suggests new horizons and also new problems and a wide plan of work. However, I agree with the author that the uncertainties which will inevitably emerge in this work must be met urgently and radically. For we know that "on the other scale-pan there are in fact the raw metaphysics of legal positivism, the conservatism of the jurists, and at best the formalistic, paralyzing ascetics" (p. 390). The merit of Negri's book seems to me to lie above all in the lively problematical tension with which he examines the Kantian thought. Following in the paths of G. Gurwitch, Metzger and Goldmann, as well as of Luk~s' History and Class Consciousness, he appreciates and understands the interpenetration of ethical motivations with the social and cultural environment. This historical and philosophical awareness of problems is particularly lively in the pages where the author notices the begging of principle in Kantian thought; a begging of principle consisting in the fact that "the definition of limit presupposes a limit to the principle itself, but the examination of this presupposition is neglected" (p. 77 ft.). Because of this critical and historical tension, Negri's book can be of great interest to the jurist, the philosopher and the historian. And if this ensues, it is because the conception of legal right which the author seeks to assert throughout his theoretical tension is deep-rooted humanly, dialectically, concretely. Tolerance, the mere “putting up” with disapproved behaviour and practices, is often considered a too negative and passive engagement with difference in the liberal constitutional state. In response, liberal thinkers have either discarded tolerance, or assimilated it to the moral and legal precepts of liberal justice. In contradistinction to these approaches I argue that there is something distinctive and valuable about tolerance that should not be undermined by more ambitious, rights-based models of social cooperation. I develop a conception of tolerance (...) as a complementary principle and an interim value that is neither incompatible with, nor reducible to, rights-based liberalism. Tolerance represents a particular, non-communitarian expression of the general dictum that the liberal state, having released its citizens into liberty, rests on social presuppositions it cannot itself guarantee. This work aims to defines the question Is there a human nature? It argues that we know our nature only when it is recognized by our culture and that the liberal democratic idea of the state both celebrates and threatens the notion of fundamental human equality.

If Christian theology is that enterprise whose essential purpose is to understand the faith of the Christian Church, then it must approach that faith from the perspective not only of its transcendent source, but also as a human achievement, a creative interpretation of those events in which transcendent reality discloses itself for appropriation. Few theologians would deny that theology has to do primarily with the ways in which ultimate reality becomes manifest in human beings' faithful responses, in belief and trust, (...) to its self-disclosures, preparatory and decisive. But the implications of such a view are not always confronted straightforwardly, especially for the suitable normative principles by which theology must assess the adequacy of the church's expressions of its faith. This essay seeks to probe how an account of the Christian faith could proceed whose norm derives not from the revelatory source of faith but from the dynamic of human creativity within which alone faith's source, in being interpreted, becomes clear, cogent, and decisive for conscious existence. Aboriginal peoples are forever explaining themselves to non-Aboriginal people: telling their stories, explaining their beliefs and ceremonies, and introducing ideas that have never crossed the non-Aboriginal mind. Western knowledge operates from a linear, singular view; it views the world from order beneath chaos; it is very noun oriented; knowledge is about oneself in relation to everything else in a relativistic sense. Aboriginal knowledge has a very different “coming to know.” It is holistic and cyclical; it views the world from chaos (...) underneath order; its languages are process and action oriented.
